PIL in Hon’ble Delhi High Court to declare “Section 9 of the Hindu Marriage Act 1955 titled Restitution of conjugal rights” Null, Void and Unconstitutional as per Article 13(2) of Constitution of India as Restitution of Conjugal Rights violates Right to Privacy Fundamental Right
On 13/09/2017, there was a hearing in Hon’ble Delhi High Court on a PIL Writ Petition Civil – 8160/2017 to declare “Section 9 of the Hindu Marriage Act 1955 titled Restitution of conjugal rights”, null void and unconstitutional as it amounts to State interference with a woman’s private decision whether or not to engage in sexual activity, and whether or not to carry a child. Also, it violates woman’s right to privacy, dignity and bodily integrity and her right to be left alone without any interference from state and non-state actors, women consent/choices and her right to refuse participation in sexual activity, along with other grounds.
A notice has been served to the Union of India by the Hon’ble Chief Justice of Delhi High Court. Next date of hearing is 8 December 2017
